The library's new electronic reserve service has generated numerous questions about both copyright and procedure. Legally, there is little difference between an electronic copy and a photocopy, so instituting an electronic reserve service does NOT in itself alter library policy regarding copied material on reserve. However, there are some procedural differences. The two sections below outline both legal and procedural issues regarding library electronic reserves. (These apply to print, nonmusical works.)
To be placed on reserve without special permission from the copyright holder, copied material must normally meet the following three criteria:
| Compliance responsibility | 1. Item must be an article, chapter, or similar short segment which constitutes a small part of a whole work (book, journal issue, etc.). | Faculty member |
|---|---|
| 2. Amount of material placed on reserve should be limited to a small portion of the total assigned reading for that course (it should not substitute for textbook or coursepack). You can arrange for a coursepack through the university bookstore; contact Anita Lafferty at the bookstore (327-7456) at least six weeks before you'll need the coursepack. | Faculty member |
If your material DOES NOT MEET BOTH of the above criteria, you must seek permission from the copyright holder before the library will place the material on reserve. While this is normally the responsibility of the faculty member, as of Fall 2002 the library will be testing the service of seeking permissions on behalf of faculty.
Special case of articles in the OhioLINK Electronic Journal Center, JSTOR, or from EBSCO (Academic Search Premier, etc): The license agreements for articles available from these sources include the right to use this material in an electronic reserve service. Special permissions need not be sought, even for repeat uses. This right does not extend to any online content providers other than the ones specifically listed here.
